These Terms of Service (“Terms”) govern your access to and use of the websites, platforms, and services operated by The Noctis Group (“Noctis,” “we,” “us,” or “our”). By accessing our platform, submitting an enquiry, or completing a booking, you acknowledge that you have read, understood, and agreed to be bound by these Terms in full.
1. Nature of Our Services & Brokerage Limitations
Noctis operates as a curator and intermediary that introduces qualified guests to a private collection of luxury estates and associated lifestyle services. We act in a facilitative brokerage capacity only. Unless expressly stated in writing, Noctis does not own, manage, or control the properties presented and is not a party to the underlying accommodation agreement between you and the property owner or their representative.
All property descriptions, imagery, pricing, and availability are provided for general guidance and are subject to change without notice. While we apply exacting standards to every estate we represent, we make no warranty that any property will meet your subjective expectations beyond the material specifications confirmed at the time of booking.
2. Bookings, Eligibility & User Liabilities
By submitting a reservation request, you represent that you are at least eighteen (18) years of age and possess the legal authority to enter into a binding agreement. You are responsible for ensuring that all information you provide — including guest counts, identification, and payment details — is accurate, current, and complete.
You accept full liability for the conduct of every member of your party for the duration of the stay. This includes adherence to the maximum occupancy, house rules, local ordinances, and any specific conditions stipulated by the property owner. Misuse of a property, unauthorized events, or material misrepresentation of the purpose of your stay may result in immediate termination of the booking without refund.
3. Property Conduct & Damage Disclaimer
Guests are expected to treat each estate with the utmost care. You agree to be held financially responsible for any loss, damage, or excessive wear caused to the property, its furnishings, art, or grounds during your occupancy, whether caused by you or any member or guest of your party. A security deposit or pre-authorization may be required and applied against any such liability.
Noctis disclaims all responsibility for personal injury, loss, or damage to personal belongings sustained on or around any property, except to the extent such liability cannot lawfully be excluded. Use of amenities — including pools, spas, watercraft, and fitness facilities — is undertaken entirely at your own risk.
4. Limitation of Liability
To the fullest extent permitted by law, Noctis shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our platform or services. Our total aggregate liability in connection with any booking shall not exceed the value of the service fee retained by Noctis for that specific arrangement.
5. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which The Noctis Group is incorporated, without regard to its conflict-of-law provisions. Where a stay takes place within a different territory, the local laws and regulations applicable to that property shall additionally govern matters of occupancy and conduct. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of our place of incorporation.
